Term of Service

1. Acceptance of Terms

By accessing or using the Site and any services provided by Agencia Cord (“we,” “us,” or “our”), you (“you,” “Client,” or “User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not access or use our Services.

2. Services

We provide lead generation, appointment-setting, homeowner data, and related marketing services (collectively, the “Services”). Specific details of a service such as scope, price, and deliverables—will be outlined in a separate Service Agreement or Order Form between you and us.

3. Client Responsibilities

You agree to:

  • Provide accurate, current, and complete information required to use the Services.
  • Comply with all applicable laws and regulations related to your use of the Services, including marketing, telemarketing, and data protection laws.
  • Ensure that any homeowner or lead data you receive is used only in compliance with our data-use restrictions and applicable legal requirements.

4. Use of Lead/Homeowner Data

When you purchase or access homeowner data through our Services, you acknowledge and agree that:

  • The data is provided solely for your internal business use.
  • You will not resell or redistribute the data unless expressly permitted under a written agreement.
  • You will use the data ethically and lawfully and take reasonable measures to protect it from unauthorized access or misuse.

5. Payment & Fees

Payment terms, pricing, refund policies, and project milestones will be defined in the applicable Service Agreement or Order Form. If you fail to make timely payments, we may suspend or terminate your access to the Services.

6. Intellectual Property

All content, design, graphics, trademarks, trade names, logos, and proprietary materials available on the Site or through the Services (“Our Materials”) are owned by Agencia Cord or our licensors. You may not copy, modify, distribute, or create derivative works from Our Materials unless expressly authorized in writing. Use of our logo, brand name, or marketing materials requires our prior written permission.

7. Confidentiality

Each party agrees to maintain the confidentiality of the other party’s non-public information disclosed in connection with the Services and to use it only for purposes permitted under the applicable Service Agreement.

8. Warranties & Disclaimers

We will provide our Services in a professional and industry-standard manner. However, except as expressly stated in the Service Agreement:

  • We make no other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee specific results, such as sales volume or lead conversion rates, unless expressly agreed upon in writing.

9. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
  • Our total aggregate liability under these Terms or any Service Agreement will not exceed the total fees paid by you to us in the preceding 12 months.

10. Termination

Either party may terminate the Service Agreement as permitted by its terms. We may suspend or terminate your access to the Site or Services immediately if you breach these Terms, violate any Service Agreement, or if required by law. Upon termination, you must stop using our Services and return or destroy any data or materials as instructed.

11. Governing Law & Dispute Resolution

These Terms and any related Service Agreement are governed by the laws of State of Texas, USA without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be resolved by arbitration or the courts.

12. Changes to Terms

We may update these Terms periodically. Revised Terms will be posted on the Site with the updated “Effective Date.” Your continued use of the Site or Services after changes are posted signifies your acceptance of the updated Terms.

13. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms and any Service Agreements constitute the entire agreement between you and us regarding the Services, superseding all prior understandings or agreements. You may not assign your rights or obligations under these Terms without our prior written consent; we may assign ours freely.
